2014 An EAP Market Update
"We’ve seen interesting changes in the employee assistance program (EAP) market over the past couple years. Most importantly, a federal regulatory rule clarification was released on December 24, 2013, confirming that EAPs are exempted from counting as excess employee benefits under the Patient Protection and Affordable Care Act of 2010 (PPACA)."
The issue with EAP's appears to be the taxability of the benefit to the employee.
Are there issues of taxabiity that impact the training services made available to an employee?

An analogous question might be - what is an education worth? Might the value produced also be a function of how hard or smart the learner uses their education? What can we do to assure the learner gets the most from their investment? Does it matter if our compensation has correlation to the learner's effort and outcomes?
